Introduction.

At Last Call Media, privacy rights are extremely important to us. We are thoughtful about the personal information we ask you to provide to us, will never ask you to provide more information than we absolutely need, and we store personal information securely for only as long as we have a reason to keep it. We aim for full transparency on how we gather, use, and share your personal information, and so we strongly encourage you to review our Privacy Policy below and to contact us if you have any questions or concerns about the information contained herein.

This Privacy Policy describes LCM’s policies and procedures regarding the collection, use and disclosure of information which you provide when you access lastcallmedia.com (the “Website”), when you use the related services and features offered on the Website, and when you register to receive our emails and related communications (the Website, the related services, features and emails, any other products and/or services offered by Last Call Media are collectively referred to as the “LCM Communications”).

Information We Collect.

Information You Provide. 

When you access the Website or subscribe to or use any LCM Communications, we may collect and store personally identifiable information (PII) about you that may include your name, email address(es), information regarding your computer system, and other information that you might provide via written communications (ie, within the text body of a contact form communication).

Cookies.

For each visitor to our Website, our web server may automatically attempt to identify the user through a cookie placed within the user’s web browser. This is done to provide users with more relevant access to the Website. From time to time we may also track information, in the aggregate, on pages and features that users access or view. The activity is collected and stored in our server’s log files.

We may log Internet Protocol (IP) addresses, or the location of your computer on the Internet, for systems administration and troubleshooting purposes. We use this information in an aggregate fashion to track access to the Website. Our email newsletters utilize tracking technology that allows us to see how many newsletter emails are opened and the email address of users who have clicked on a given link or feature. We use this information for internal purposes only, to measure the aggregate number of people who view a given newsletter item.

We may use third-party vendors and service providers to assist in providing the LCM Communications. These vendors may use cookies, web beacons or similar technologies to provide services to us. In doing so, these vendors may collect non-personal information such as your browser type, your operating system, Web pages visited, time of visits, content viewed, ads viewed, and other clickstream data. You may have additional rights regarding opt-out-of services offered by our third-party vendors if you reside in a jurisdiction such as the European Union which provides for enhanced user rights.

How We Use This Information.

We mainly use information about you to monitor and analyze trends to better understand how users interact with our site (including, but not limited to: which blog posts people seem to like the most, which client stories people are most interested in, and whether or not people can find our contact form).

We may process information that you provide to us for the purpose of subscribing to our email notifications and/or newsletters. We use this data for the purposes of sending you relevant notifications and newsletters, and you can unsubscribe at any time.

We may also process information contained in or relating to any communication that you send to us (“correspondence data”). The correspondence data may include the communication content and metadata associated with the communication. Our Website will generate the metadata associated with communications made using our website contact forms. We use this correspondence data for the purposes of communicating with you and record-keeping.

Sharing Your Information.

Last Call Media does not sell any information provided to us, to anyone, for any reason. Because LCM does not utilize subcontractors or have any subsidiaries, the only people with access to the information that you share with us are Last Call Media employees. We require all employees to follow this Privacy Policy for personal information that we share with them.

Third Party Vendors. 

We may share information about you with third-party vendors who need to know information about you in order to provide their services to us, or to provide their services to you or your site. This group includes vendors that help us provide our Services to you (like email delivery services that help us stay in touch with you, customer chat and email support services that help us communicate with you, registrars, registries, and data escrow services that allow us to provide domain registration services, and your hosting provider) and those that help us understand and enhance our Services (like analytics providers), who may need information about you in order to, for example, provide technical or other support services to you. We require vendors to agree to privacy commitments in order to share information with them. Below are the third-party vendors/applications that Last Call Media currently engages with:

Google - We use Google Analytics to track site statistics and user demographics, interests and behavior on the Website. Google’s Privacy and Terms explain how it uses information from the Website.
MailChimp - We use MailChimp to manage our email subscriber lists and send emails to our subscribers. MailChimp’s Privacy Policy explains how it uses information from the Website.
Disqus - We use Disqus to enable visitors to post comments on our Website.  If you register with and use Disqus, Disqus may collect and use other information from and about you. You should review Disqus’ Privacy Policy to learn more about its privacy practices.
FreshChat - We use FreshChat to allow site visitors to live chat with our Client Services team. FreshChat’s Privacy Policy explains how it uses information from the Website.
HubSpot - We use HubSpot to track email engagement outside of newsletters and procurement leads. HubSpot’s Privacy Policy explains how it uses information from the Website and emails.
Pantheon - We use Pantheon to host our site, and recommend it as a hosting platform to many of our clients that we feel would be a good fit for Pantheon. Pantheon’s Privacy Policy explains how it uses information from the Website.

Legal Requests.

In the event that it should be necessary, we may disclose information about you in response to a subpoena, court order, or other governmental request.

To Protect Rights, Property, and Others. 

We may disclose information about you when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of Last Call Media, third parties, or the public at large. For example, if we have a good faith belief that there is an imminent danger of death or serious physical injury, we may disclose information related to the emergency.

Business Transfers. 

In connection with any merger, sale of company assets, or acquisition of all or a portion of our business by another company, or in the unlikely event that LCM goes out of business or enters bankruptcy, user information would likely be one of the assets that is transferred or acquired by a third party. If any of these events were to happen, this Privacy Policy would continue to apply to your information and the party receiving your information may continue to use your information, but only consistent with this Privacy Policy.

With Your Consent.

We may share and disclose information with your consent or at your direction.

Information Shared Publicly. 

Should you publicly share information with Last Call Media, that information may be disclosed by LCM publicly. Public information may be indexed by search engines or used by third parties. Please keep this in mind when deciding what you would like to share.

Additional use of your personal information that is not described in this Privacy Policy will only take place as required by statute or when we have obtained your consent.

Other Websites.

This Website and LCM Communications may contain links to other websites or services that may be subject to less stringent privacy standards. Last Call Media cannot assume any responsibility for the privacy practices, policies, or actions of the third parties that operate these websites or services. We are not responsible for how such third parties collect, use or disclose your personal information. You should review their privacy policies before providing them with personal information.

Opting Out.

We are committed to providing users of LCM Communications with the choice to receive or not receive emails, promotional materials, and/or other communications from Last Call Media. We only send newsletters to users who have requested or consented to receive emails about our services and products. We do not send unsolicited commercial emails (“spam”), buy or sell email lists, or use purchased or harvested email lists. We offer newsletter recipients the opportunity to opt-out of further communications in every email. If you want to stop receiving commercial emails, promotional or other marketing materials, you can do so at any time by contacting us at [email protected].

Non-US Users.

The LCM Communications are operated in and provided from the United States. If you are located in Canada, the European Union or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using the LCM Communications, participating in any of our services and/or providing us with your information, you consent to this transfer.

California and Canadian Users.

Under the California “Shine The Light” law, California residents may opt-out of the disclosure of personal information to third parties for the third parties’ direct marketing purposes. Canadian residents also have certain rights to know how their information may be shared with third parties for direct marketing purposes. As detailed above, you may contact us for such information or to opt-out of the sharing of your personal information with third parties for marketing purposes at any time by sending an email stating this preference and including your full name and email address to [email protected]. Please note that this opt-out does not prohibit disclosure for non-marketing purposes.

General Data Protection Regulation (GDPR).

The General Data Protection Regulation, effective May 25, 2018, requires that certain information and certain rights be provided to residents of the European Union. These rights include:

Please note that, as stated previously, Last Call Media has its headquarters in the United States, so information we collect from you regardless of your physical geographic location will be processed and stored in the United States. Security.

While no online service is 100% secure, we work hard to protect information about you against unauthorized access, use, alteration, or destruction, and take reasonable measures to do so, such as monitoring our Services for potential vulnerabilities and attacks.

Governing Law and Jurisdiction.

This Privacy Policy shall be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions. Any dispute arising under or in relation to this Policy shall be resolved exclusively in the Commonwealth of Massachusetts.
